These Terms are drafted in compliance with the Electronic Communications and Transactions Act 25 of 2002 (“ECT Act”) and the Consumer Protection Act 68 of 2008 (“CPA”). By accessing our website or placing an order, you agree to be bound by these Terms.

1. About Us

Poke Cartel is an online retailer of Pokemon Trading Card Game products based in South Africa, operating at www.pokecartel.co.za. Contact: info@pokecartel.co.za

2. Eligibility

  • You must be at least 18 years of age to purchase independently.
  • Persons aged 13 to 17 may purchase with parental/guardian consent and supervision.

3. Products & Descriptions

We make every effort to ensure product descriptions, images, and prices are accurate. Product images may vary slightly due to screen settings. Availability is subject to stock levels.

4. Pricing & Payment

  • All prices are in South African Rand (ZAR).
  • We reserve the right to change prices at any time. The price at order confirmation is the price you pay.
  • Payment is processed securely through Yoco, Payfast or Payflex.
  • An order is confirmed once payment is successful and you receive a confirmation email.

5. Electronic Transactions (ECT Act)

  • Your order constitutes an offer to purchase, which we may accept or decline.
  • A transaction is concluded when you receive an order fulfilment confirmation email.
  • You have the right to review and correct your order before final submission.
  • You may withdraw within the cooling-off period per our Refund & Returns Policy.

All content on this website is the property of Poke Cartel SA or its licensors. “Pokemon” and all related trademarks are the property of The Pokemon Company, Nintendo, and their affiliates. Poke Cartel SA is an independent retailer and is not affiliated with or endorsed by The Pokemon Company or Nintendo.

7. Limitation of Liability

  • Poke Cartel shall not be liable for any indirect, incidental, or consequential damages.
  • Our total liability shall not exceed the amount you paid for the product in question.
  • We are not liable for delays caused by events beyond our reasonable control.

Nothing in these Terms excludes your rights under the CPA that cannot be excluded by law.

8. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Disputes shall be subject to the exclusive jurisdiction of the South African courts.

9. Dispute Resolution

  2. If unresolved within 14 business days, either party may refer to mediation.

10. Amendments

We may update these Terms at any time. Continued use of the website after changes constitutes acceptance.
